Terms and Conditions
1. Scope
These Terms and Conditions apply to all orders placed by consumers via the online shop operated by Beatrix Milecz on milecz.com.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or self-employed professional activity.
2. Contracting party
The purchase contract is concluded with:
Beatrix Milecz
Hauptstraße 28
77756 Hausach
Germany
Email: atelier.milecz@gmail.com
Phone: +49 176 55065412
3. Conclusion of contract
The products displayed in the online shop do not constitute a legally binding offer but a non-binding invitation to place an order.
By submitting the order through the checkout, you make a binding offer to conclude a purchase contract for the goods contained in the shopping cart.
The contract may be accepted by an order confirmation sent by email or by dispatch of the goods.
4. Prices and shipping costs
All prices shown are final prices. No VAT is charged pursuant to Section 19 German VAT Act (UStG).
In addition to the stated product prices, shipping costs apply. Shipping costs are explained separately on the “Payment and Shipping Terms” page and are displayed during checkout.
5. Payment terms
Payment is made exclusively online via WooPayments.
Depending on availability, WooPayments may offer the following payment methods in particular: credit card / debit card, Klarna, Apple Pay, and Google Pay.
Charging takes place as part of the respective payment process under the terms of the payment service provider used.
6. Delivery terms
Delivery is available worldwide to the shipping address specified by the customer.
Unless a different period is stated in the respective offer, delivery time for immediately available goods, in particular finished paintings and prints, is generally 1 to 2 weeks from conclusion of the contract.
For individually commissioned or personalized works, the production and delivery time depends on the specific order, especially the size, technique, and level of detail. For that reason, no generally binding delivery period can be stated in advance; however, buyers will receive individual feedback after ordering about the expected completion time. The aim is generally to complete even more complex commissioned works within about one month.
7. Retention of title
The goods remain the property of Beatrix Milecz until full payment has been made.
8. Right of withdrawal
Consumers generally have a statutory right of withdrawal. Further information can be found in the Right of Withdrawal notice on the website.
The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs.
9. Warranty
The statutory rights in the event of defects apply.
10. Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless this deprives consumers of the protection of mandatory provisions of the law of the country in which they have their habitual residence.
11. Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR): <https://ec.europa.eu/consumers/odr/>.
There is no willingness or obligation to participate in dispute resolution proceedings before a consumer arbitration board.
